Partner terms
The terms of the Kickbytes partner program (KvK 42181275), short and readable. This is a draft text.
1. Referrer, not a representative
You refer clients. You have no authority to give quotes, prices or promises on behalf of Kickbytes and you are not an employee or commercial agent of Kickbytes. Kickbytes decides if, when and on which terms an assignment is accepted. There is no exclusivity, in either direction.
2. When you earn a commission
You earn a percentage of the net amount (excluding VAT) that a client you referred has actually paid for one-off work, such as a website, software or additional work. The standard percentage is 10%. If you agreed your own percentage, it applies to referrals that arrive from then on. No commission is due on monthly services (hosting, maintenance), on VAT, or on amounts that were not paid or were refunded.
3. Attribution
A client is credited to you if they arrive through your link and were not already known to us through another channel. The first referrer within 30 days counts. Your own requests, requests from existing clients and previously known contacts do not count. Kickbytes decides attribution based on its own records and explains how on request.
4. Payouts
A commission becomes payable 30 days after the client's payment. We pay by bank transfer once the payable amount is at least € 50. If a client's payment is refunded or reversed, the related commission lapses, or is offset if it was already paid out. Business partners send an invoice; individual partners are responsible for their own tax return.
5. Rules
No spam and no unsolicited messages. No misleading or untrue statements about Kickbytes, and you do not present yourself as Kickbytes. You do not advertise on the name Kickbytes or variants of it as a keyword. Share other people's contact details only with their consent and follow privacy law.
6. Privacy
We store your name, email address, optionally company name and bank account to run the program and pay out. Payment data is kept as long as the tax retention duty requires (7 years). The clients you refer are Kickbytes' own clients; you do not get to see their details. See also the privacy statement.
7. Ending and changes
You and Kickbytes can end the partnership at any time. Commissions on payments already received remain. If the rules are broken, Kickbytes can stop at once and any unpaid commission lapses. Changes to these terms or the percentage are announced at least 30 days ahead by email and apply to new referrals.
8. Applicable law
Dutch law applies. Disputes are brought before the competent court in the Netherlands.
